Touch-A-Life Foundation and its affiliates (referred as “TAL,” or “TouchALife,” “TALBlood Aid” the “Company,” “us,” or “our”) is a Non-Profit Organization Platform serves as a collaborative space for diverse activities, fostering connections between individuals and organizations dedicated to our shared mission. These thorough policies have been developed to guide users, ensuring ethical engagement and responsible utilization of the platform.
TALBlood Aid maintains this innovative platform designed to facilitate life-saving blood donations by connecting Donors with those in need (“Donee”), facilitating secure and efficient blood donations through user registration, public visibility and protected communication (“Services”) (Donor and Donee are collectively referred to as, the “Users” and individually as “User”). Our application allows Users to register as blood donors and to respond to requests of Donee. TALBlood Aid ensures that all request details are publicly visible while keeping contact information private until a Donor chooses to connect.
The purpose of this terms of service is to delineate the guidelines and procedures governing the engagement of individuals utilizing the TALBlood Aid platform to connect Users with each other. It aims to promote responsible use of the platform, protect User information such as email, phone numbers or blood type, and support the health and well-being of our community by ensuring that requests are handled with the utmost care and urgency. By adhering to this terms of service, TALBlood Aid strives to maintain a trustworthy and efficient service that connects those in need of blood with willing and available Donors.
The utilization of the platform or the Service is deemed null and void in jurisdictions where such use is prohibited. This platform is specifically designed for individuals who are between eighteen (18) to sixty-five (65) years of age and weigh not less than 45 kgs. If you are under the age of 18 or above 65, it is imperative that you engage with this platform under the direct supervision of an adult. Through the act of utilizing the Service or accessing the platform, you hereby assert and guarantee that you are aged 18 or older but not more than 65 years, and affirm your consent to comply with and abide by the comprehensive policies established by this platform.
Every individual utilizing the platform must thoroughly review and comprehend these Terms and Conditions, collectively known as T&C, along with the periodically updated Privacy Policy. It is imperative for Users to familiarize themselves with these documents.
By engaging with the Platform, all Users, including their representatives (such as officers, agents, directors, governing body members, and other representatives), implicitly express their agreement to abide by the terms and conditions (T&Cs) before accessing or utilizing the Platform.
Users, encompassing both Donor and Donee, are required to furnish accurate and complete information when creating profiles on the TALBlood Aid Platform. TALBlood Aid, while providing the platform for connectivity, refrains from validating the legitimacy of user profiles and does not guarantee the accuracy of the information provided.
The TALBlood Aid platform may afford Users the capability to post or transmit information, text, data, photographs, audio, video, images, graphics, logos, trademarks, service marks, and other materials (collectively referred to as "User Content") to or through the platform. It is explicitly understood by the User that all User Content, along with the ramifications of such content posting, constitutes the sole responsibility of the User and is subject to the terms delineated in the terms of service and the Privacy Policy.
The User acknowledges that the act of accessing the platform or Services may expose them to User Content that could be deemed offensive or objectionable. While TALBlood Aid retains the discretionary authority, it is not under any obligation to preview or review any User Content. In the sole discretion of TALBlood Aid, User Content that violates the terms of service or is otherwise objectionable may be blocked or removed from the platform without prior notice. However, the failure to block or remove any User Content does not imply an endorsement, warranty, representation, or guarantee concerning said User Content.
The User affirms and guarantees that the User Content does not infringe upon the copyright, trademark, publicity/privacy rights, or any other intellectual property or proprietary right of any third party. Furthermore, the User asserts that they have settled and will discharge any fees or other payments pertinent to the utilization of their User Content.
Through the act of posting, uploading, or otherwise disseminating User Content on the TALBlood Aid platform, the User hereby grants (and represents and warrants that they possess all requisite rights to grant) TALBlood Aid an enduring, sub-licensable, transferable, global, non-exclusive, royalty-free, fully paid license to exercise all User rights in the User Content (including moral rights) for all conceivable purposes. Such purposes encompass, but are not limited to, the right to use, copy, reproduce, modify, adapt, publish, edit, translate, create derivative works from, transmit, distribute, display, perform, or derive revenue or other remuneration from the User Content, and to integrate such User Content into other works across any form, media, or technology.
By furnishing User Content to the platform or Services, the User grants TALBlood Aid the authority to identify the User as the provider of said User Content through any form, media, and technology. The User concurs that TALBlood Aid bears no liability or responsibility for the storage or deletion of any User Content submitted or posted through the platform or Services.
The TALBlood Aid platform, excluding User Content, is the exclusive property of Touch-A-Life Foundation, its licensors, and/or various third-party providers and distributors. The TALBlood Aid platform is safeguarded by copyright, trademark, and other intellectual property laws. Users are obligated to retain all copyright and trademark notices, including any additional proprietary notices, incorporated in the materials. Users agree not to modify, obscure, or obliterate any such notices. Unless explicitly stated otherwise in these terms of service, users are expressly prohibited from copying, reproducing, republishing, selling, transferring, modifying, or distributing any content or data found on the TALBlood Aid platform without the prior written consent of TALBlood Aid, its licensors, and/or third-party providers and distributors.
Trademarks, logos, images, and service marks exhibited on the TALBlood Aid platform are the sole property of Touch-A-Life Foundation or other third parties. Users expressly agree not to display or utilize any TALBlood Aid or third-party marks without obtaining the prior written consent of TALBlood Aid or the appropriate third-party licensor. TALBlood Aid reserves all rights not explicitly granted to the User.
TALBlood Aid is a platform which serves as an intermediary connecting two distinct categories of individuals, namely those inclined to offer assistance and those seeking aid. The services proffered by the platform are designed to create an efficient, user-friendly experience that encourages blood donation and ensures that those in need receive timely assistance.
TALBlood Aid disclaims liability for the actions or outcomes of Donor or Donee, and users must adhere to a code of conduct respecting privacy laws and regulations, including Digital Personal Data Protection Act, 2023, Information Technology Act, 2000 and other applicable laws . TALBlood Aid disclaims liability for any outcomes related to these engagements.
The fundamental purpose of our platform is to facilitate the provisions of Services by fostering a symbiotic relationship between these two User groups. Users expressing a willingness to extend help are matched with individuals or entities in need, thereby creating dynamic and reciprocal assistance network. It is imperative to note that the services offered through our platform are voluntary provided, and the platform itself does not engage in the direct provision of services but rather acts as a conduit for the interaction between Users.
This framework establishes a collaborative environment wherein Users can engage in mutual beneficial relationships, and any agreements, arrangements, or transactions undertaken as a result of these connections are deemed to be the sole responsibility of the involved parties. The platform, in adherence to applicable legal standards, assumes no liability for the nature, quality, or outcomes of the services exchanged between Users.
Users are held to a high standard of ethics and responsibility when engaging on the TALBlood Aid platform. TALBlood Aid assumes no responsibility for the accuracy of User-posted content and disclaims liability for any claims, damages, or losses arising from such content. Users, in posting information, materials, or content, or in accessing the platform or Services, expressly covenant not to:
Users are obligated to employ the platform and Services in a responsible and legal manner, refraining from misrepresentation, spam, content manipulation, or interference with services or networks. Strict adherence to applicable local, state, and federal laws, statutes, and regulations governing the utilization of the platform and Services is mandatory. TALBlood Aid explicitly reserves the right to undertake investigations and pursue legal recourse for violations, including collaboration with law enforcement authorities where warranted. Violations of these terms of service may result in legal consequences.
TALBlood Aid is committed to upholding user privacy in full compliance with applicable data protection laws. Users bear the responsibility for maintaining the confidentiality of their shared information on the platform, with TALBlood Aid disclaiming liability for any breaches. Intellectual Property and Services Usage: By using the Services, you acknowledge and agree that the content and features within the Services ("Services Content") are protected by various intellectual property rights, including but not limited to copyright, patent, trademark, and trade secret laws. Unless expressly authorized by TALBlood Aid, you agree not to engage in activities such as modifying, copying, framing, scraping, renting, leasing, selling, distributing, or creating derivative works based on the Services, the Services Content, or any other content, whether in whole or in part. This restriction excludes User Content that you legally upload to the Services. You further agree not to employ data mining, spiders, robots, scraping, or similar methods for gathering or extracting data in connection with your use of the Services. If TALBlood Aid blocks your access to the Services, you commit to refraining from implementing any measures to circumvent such blocking, such as masking your IP address or using a proxy IP address. Unauthorized use of the Services or the Services Content is strictly prohibited. The Software that underlies the Services or is distributed in connection with them is the property of TALBlood Aid, our affiliates, and partners (collectively, the "Software"). You explicitly agree not to copy, modify, create derivative works, reverse engineer, reverse assemble, or attempt to discover any source code related to the Software. Selling, assigning, sublicensing, or transferring any rights in the Software is strictly prohibited unless expressly authorized herein. Any rights not expressly granted are reserved by TALBlood Aid.
TALBlood Aid values and respects the intellectual property rights of others. If you believe that a user has violated your intellectual property rights, kindly inform TALBlood Aid in writing via email or mail at support@talbloodaid.org . It is understood and agreed that upon receiving and acknowledging a claim of infringement, TALBlood Aid reserves the right to promptly remove the specified materials from the platform and Services without incurring any liability.
If, at the discretion of TALBlood Aid, a User is found to be a repeat infringer, their account may be terminated. Repeat infringers refer to Users who have faced more than one legitimate takedown request without successful rebuttal.
The TALBlood Aid platform may incorporate links to or encapsulate third-party websites or services, and may automatically redirect users to sponsors' or third parties' websites or services. Donor and Donee hereby agree, consent and acknowledge that we shall share this information with third parties who reasonably require such information to facilitate our Services. TALBlood Aid provides such links and framing exclusively for user convenience. TALBlood Aid does not conduct reviews or extend endorsements and is not accountable for any content, advertising, products, services, or other materials present on or accessible through such websites or services. The user assumes complete responsibility for their utilization of third-party websites or services. Interactions between the user and organizations or individuals encountered on or through the platform and Services are solely the responsibility of the user and such entities. Before engaging in any interaction with these third parties, the user should conduct any necessary or appropriate investigations. The user acknowledges and agrees that TALBlood Aid is neither responsible nor liable for any form of loss or damage incurred as a result of such interactions. In the event of a dispute between users or between users and any third party, the user understands and agrees that TALBlood Aid is not obligated to intervene. If the user has a dispute with any other user, the user hereby releases TALBlood Aid and its affiliates, as well as their officers, employees, agents, and successors, from claims, demands, and damages of every kind or nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes or the platform and Services.
The utilization of the platform and services by the user is undertaken at their own risk. The platform, services, and the content therein, or the content provided by TALBlood Aid, are presented "as is" and "as available." To the maximum extent permissible by applicable law, all warranties, whether express or implied, are disclaimed, encompassing but not limited to implied warranties of merchantability, quiet enjoyment, non-infringement, and fitness for a particular purpose.
In particular, TALBlood Aid and its officers, employees, directors, shareholders, parents, subsidiaries, affiliates, agents, and licensors (collectively referred to as "affiliates") make no assertions or guarantees regarding the accuracy or completeness of the content available on or through the platform or services (including, without limitation, any recommendations or other content available on or through the platform or services), or the content of any websites or resources linked to or framed on the platform or services. TALBlood Aid and its affiliates bear no liability for any: (a) errors, mistakes, or inaccuracies of content; (b) personal injury or property damage resulting from the user's access to or use of the platform or services; (c) any unauthorized access to or use of TALBlood Aid’s servers or of any personal or financial information; (d) any interruption of transmission to or from the platform or services; (e) any computer viruses or malicious code that may be transmitted on or through the platform or services; or (f) any loss or damage of any kind incurred as a result of the use of any functionality or content posted, emailed, transmitted, or otherwise made available on or through the platform or services.
TALBlood Aid and its affiliates do not guarantee, endorse, or assume responsibility for any third-party product or service recommended, advertised, or offered on or through the platform or services or any linked or framed website.
The user comprehends and agrees that any material or information downloaded or otherwise obtained through the use of the platform or services is done at the user's own risk, and the user will be solely responsible for any damage arising from such actions. No advice or information, whether oral or written, obtained by the user from TALBlood Aid or through the platform or services, will create any warranty not expressly made in these terms of service.
To the maximum extent allowable by applicable law, TALBlood Aid and its affiliates shall not be held liable under any legal theory (whether in contract, tort, negligence, or otherwise) for any indirect, incidental, special, consequential, punitive, or exemplary damages. This includes damages for the loss of revenues, profits, goodwill, use, data, or other intangible losses, even if such parties were informed of, knew of, or should have known about the potential for such damages, arising from or relating to the platform or services or these terms of service.
Certain jurisdictions may not permit the exclusion of specific warranties or the limitation or exclusion of liability for incidental or consequential damages. Consequently, some of the aforementioned limitations and disclaimers may not be applicable to the User. To the extent that TALBlood Aid, as a matter of applicable law, cannot disclaim any implied warranty or limit its liabilities, the extent and duration of such warranty, as well as the extent of TALBlood Aid’s liability, shall be the minimum permissible under such law.
Users bear complete responsibility for safeguarding the confidentiality of passwords and accounts. Additionally, Users are wholly accountable for all activities transpiring under their account. The User hereby undertakes to indemnify, defend, and hold harmless TALBlood Aid and its Affiliates from any and all claims, liabilities, damages, losses, costs, expenses, and fees of any nature (including reasonable attorneys' fees and legal costs) arising from or related to: (a) any information (including User's User Content or any other content) submitted, posted, or transmitted on or through the platform by the User or anyone utilizing the User's account; (b) the utilization of the platform by the User or anyone using the User's account; (c) the breach of these terms of service by the User or anyone using the User's account; or (d) the infringement of any rights of a third party, encompassing intellectual property, privacy, publicity, or other proprietary rights by the User or anyone using the User's account. TALBlood Aid retains the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by the User. In the event that TALBlood Aid assumes the defense of such a matter, the User agrees to reasonably cooperate with TALBlood Aid in such defense. The User also commits to promptly notify TALBlood Aid of any unauthorized use of their account or any other breach of security within their knowledge.
TALBlood Aid retains the exclusive discretion, at its sole determination, to promptly suspend or conclude the User's registration, the terms of service, and/or the User's access to the entire platform or Services, with or without prior notice. This may include the removal of any registration details or User Content from the platform or Services, and such actions can be taken for any cause. Following the termination or expiration of the terms of service, the User's responsibilities and TALBlood Aid’s entitlements and disclaimers persist, but the User's entitlement to utilize the platform and Services ceases forthwith.
This comprehensive terms of service shall be interpreted and governed by the laws of the India, without regard to its conflict of law principles. The User agrees that any legal action arising from or related to these Policies, the platform, or any Services shall be exclusively filed in the courts of Hyderabad. The User consents and submits to the personal jurisdiction of such courts for the resolution of any such action. Any provision in these Policies that is deemed invalid or unenforceable will be removed and replaced with a valid and enforceable provision that accomplishes, to the extent possible, the same objectives as the severed provision intended to achieve. The remaining provisions of these Policies will remain in full force and effect. These Policies, and the terms contained herein, shall not be construed as establishing or constituting a partnership, joint venture, or agency relationship between the parties. The User is prohibited from assigning, sublicensing, or otherwise transferring any rights or obligations outlined herein without the prior written consent of TALBlood Aid. Any purported assignment in violation of the preceding sentence is null and void. TALBlood Aid reserves the right to assign its rights and obligations under these Policies, including in connection with a merger, acquisition, sale of assets, or by operation of law. Subject to the foregoing, these Policies are binding on the parties' respective successors and permitted assigns. The failure of TALBlood Aid to exercise or enforce any of its rights under these Policies shall not constitute a waiver of such rights. Unless expressly provided otherwise herein, all remedies specified herein shall be cumulative and in addition to, not in lieu of, any other remedies available to either party at law, in equity, or otherwise.
Periodically, TALBlood Aid reserves the right to revise or amend these terms of service. Such revisions or modifications will be communicated by posting the updated terms of service via a link on the TALBlood Aid platform. The effective date of these changes will be indicated by the "Last Updated" date specified in the revised terms of service. By persisting in the access or utilization of the platform or Services subsequent to the implementation of such modifications, the User implicitly consents to the revised Terms. In the event that the User dissents from any provision articulated in these terms of service, the User is expressly prohibited from accessing or utilizing the platform and Services.
